Information and Terms and Conditions

1.It is the responsibility of all stallholders to have their own valid Public and Product Liability Insurance. Please contact us if you need advice on how to obtain this.

2.No refund will be made under any circumstances, including weather conditions.

3.The Market opens to Stallholders from 6.30am and you will be expected to be setup by 8.30am.

4.The Festival Market is located on Napier Street (the main street in St Arnaud) which will be closed to through traffic. Stallholders must NOT go through the erected barriers, entry is via Dundas Street, then into Alma Street. On arrival at the checkpoint you will receive your allotted Site Number.

5.Vehicles are not permitted to remain on site unless by prior arrangement with the Market Co-ordinator.

6.No Stallholders are permitted to bump out, pack up or close before 2.30pm (unless due to arrangement with the Festival Market Co-ordinator).

7.Market stall sites are available for the sale of quality items such as plants, clothing, leather goods, pottery and ceramics, home ware, giftware, jewellery, books, speciality food and general art and craft items. Community display stalls are also welcome.

8.Stalls selling or serving alcohol must have the appropriate liquor license, which must be on display at all times during the market day. A copy of your liquor license must be provided with your Market Day application form.

9.General food stalls, eg. coffee/tea & fast food (eg. hot chips, hot dogs, hamburgers) are not permitted.

10.All market stalls are to be well presented and tidy at all times. All items and stock must remain within the boundaries of your site at all times. You must manage your own waste.

11.Market stall holders are required to supply their own equipment i.e. tables, chairs, tarpaulins etc, unless hiring trestles from the Festival Committee.

12.Market stall holders are to provide their own shade structure if required. All shade structures, canopies are to be weighted down, NO pegging into the road is permitted.

13.No power or water is available for use by market stall holders. No extra generators are to be used unless discussed in advance and approved with the Festival Market Co-ordinator.

14.The sale of inappropriate material, including obscene pictures or offensive language is not permitted. Fireworks, Firecrackers or Silly String products, or similar items, are prohibited at the Festival Market.

15.The stallholder must not transfer, sub-let, assign or in any other manner or form dispose of its space leased from the festival. No stallholder will be permitted to operate within the festival precinct without prior arrangement with festival management

16.The festival management will not accept any responsibility for the safety of any article or product of any kind brought by the Stallholder into the Festival Market. Stallholders must at all times comply with all laws, regulations and requirements of local Government and other statuary authorities

17.The stallholder hereby indemnifies the festival and holds the festival harmless in respect to all costs, claims, demands and expenses to which the festival may in any way be subjected as a result of any loss or injury to any person or company including members of the public, the staff or authorities, the festival or stallholders, employees, servants, agents and invitees howsoever caused as a result of any act, neglect or default by the stallholder. Stallholders with staff must have the appropriate Work Cover policies in place

18.The festival shall not be responsible for any loss or any nature including monies paid to the festival, suffered by any stall holder from any restrictions or conditions which prevent the construction, erection, completion, alteration or dismantling of any stall or exhibit or for the setting or removal of any products, exhibits and/or van or for the failure of any services available to the market stall holder, or for any cancellation or restriction in opening hours at the Festival of St Arnaud as a result of any circumstances not within the direct control of the festival

19.The market stall holder may not conduct lotteries, raffles or competitions without the consent of the Festival Market Co-ordinator.

20.Any decision of the festival shall be final and binding. The festival reserves the right to refuse any application and to remove any stallholder and its stall at the stallholders cost.
